1. Acceptance of Terms

By accessing, browsing, or utilizing NabkaAI's agency services, AI agents, visual builder tools, or web applications, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Description of Services

NabkaAI provides done-for-you AI solutions and self-service agent tooling, including:

  • Custom AI Voice Receptionists for inbound call answering, qualification, and appointment booking
  • Restaurant AI Ordering channels (WhatsApp, SMS, Web) integrated with POS systems
  • AI Outbound SDR systems for targeted B2B pipeline generation
  • Agent creation tools, runner environments, and marketplace catalogs

3. Subscriptions, Fees & Cancellation

Agency services and premium tiers are billed on a flat monthly or annual subscription cadence. Month-to-month plans may be canceled at any time. Annual plans receive waived setup fees and two months free, and are transferable across locations. Volume overage is billed at standard flat per-call/per-order rates with advance notifications.

4. Acceptable Use Policy

You agree not to use NabkaAI agents or APIs for:

  • Unlawful spam, unsolicited robocalls violating TCPA regulations, or deceptive phishing
  • Harassment, impersonation without disclosure, or distribution of malicious code
  • Attempts to reverse engineer or exhaust infrastructure capacity via unauthorized scraping

5. Intellectual Property & Ownership

Clients retain all ownership rights to their proprietary customer data, uploaded restaurant menus, and business brand assets. NabkaAI retains ownership of its underlying platform code, proprietary prompt scaffolds, and system architecture.

6. Limitation of Liability

AI agents provide automated assistance. While we implement extensive guardrails and fallback escalation routing, NabkaAI is not liable for indirect or consequential damages arising from telecom interruptions, POS synchronization delays, or third-party carrier outages.
