By accessing or using NabkaAI's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time.

2. Description of Service

NabkaAI provides an AI agent marketplace where users can create, share, and monetize AI agents. Our services include AI chat functionality, a visual agent builder, and a marketplace for discovering and using AI agents created by the community.

3. User Accounts

When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Be at least 18 years old or have parental consent

4. Acceptable Use

You agree NOT to use our services to:

• Generate harmful, illegal, or deceptive content
• Harass, abuse, or harm others
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to bypass rate limits or security measures
• Create agents that impersonate real individuals without consent
• Generate spam, malware, or phishing content

5. Rate Limits

Free users are limited to 10 AI chat requests per day. This limit resets at midnight EST. Premium agents may have different usage limits as specified on their marketplace pages. Attempting to circumvent rate limits may result in account suspension.

6. Agent Marketplace

When publishing agents to the marketplace:

• You retain ownership of your agent configurations and prompts
• You grant NabkaAI a license to host and distribute your agents
• You are responsible for your agent's behavior and outputs
• Premium agent sales are subject to a 15% platform fee
• Payouts are processed via Stripe according to their terms

7. Payments and Refunds

All payments are processed securely through Stripe. Premium agent purchases are non-refundable unless the agent is defective or significantly misrepresented. Disputes should be reported within 7 days of purchase.

8. Intellectual Property

NabkaAI's platform, branding, and proprietary technology are protected by intellectual property laws. Content you create using our tools remains yours, but you grant us a license to use it for providing and improving our services.

9. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not guarantee that AI outputs will be accurate, complete, or suitable for any purpose. You use AI-generated content at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, NabkaAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.

11. Termination

We may suspend or terminate your account at any time for violations of these terms. You may delete your account at any time through your dashboard settings. Upon termination, your right to use the services ceases immediately.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
